These Terms of Service (“Terms”) govern your use of the BMAI Canada website (the “Site”) and any purchases made through the Site. The Site is operated by BMAI Canada (“we”, “us”, “our”). By accessing the Site and/or purchasing from us, you agree to be bound by these Terms.

1) Online Store Terms

By using this Site, you represent that you are at least the age of majority in your province/territory of residence, or you have given us your consent to allow any of your minor dependents to use this Site.

All product descriptions and prices are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

We have made every effort to display product images and colors as accurately as possible; however, we cannot guarantee your device display will be accurate.

5) Orders, Billing, and Account Information

We reserve the right to refuse or cancel any order you place with us. We may limit or cancel quantities purchased per person, per household, or per order.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

6) Order Cancellation (Self-Serve)

If your order has not entered fulfillment (for example, not packed, no shipping label created, and not handed to the carrier), you may be able to cancel it directly through your customer account or the Shop App (if available). A successful cancellation will trigger an automatic refund to the original payment method.

7) Shipping and Delivery

Delivery times shown on the Site or at checkout are estimates and are not guaranteed. Carrier delays, weather, holidays, remote locations, and other factors outside our control may impact delivery.

10) Optional Tools

We may provide you access to third-party tools which we do not monitor or control. You acknowledge and agree that we provide access to such tools “as is” and “as available,” without warranties or representations.

All content on the Site (including text, graphics, logos, images, and software) is owned by or licensed to BMAI Canada and is protected by Canadian and other applicable intellectual property laws. You may not use our trademarks or content without our prior written consent.

The Site and services are provided on an “as is” and “as available” basis. We do not guarantee that your use of the Site will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow limitations on implied warranties; to the extent such limitations are not permitted, these disclaimers may not apply to you.

16) Limitation of Liability

To the maximum extent permitted by applicable law, BMAI Canada (including our directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers) shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Site or products.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws. Any provision that is unenforceable will be severed to the extent necessary, and the remainder will remain in effect.

These Terms remain effective unless terminated by you or us. We may terminate or suspend your access to the Site if you breach these Terms, subject to applicable law.

21) Governing Law

These Terms shall be governed by the laws of the Province of British Columbia and the applicable federal laws of Canada. You and BMAI Canada consent to the jurisdiction of the courts located in Vancouver, British Columbia, subject to applicable consumer protection laws.
